General Terms and Conditions (GTC)
1. Scope
These General Terms and Conditions (GTC) apply to all contracts between Beltrona GmbH & Co. KG and its customers (consumers) concerning the sale of goods via our online shop and via marketplaces (e.g. eBay).
A consumer within the meaning of these Terms and Conditions is any natural person who enters into a legal transaction for private purposes.
2. Conclusion of the contract
The presentation of the products does not constitute a legally binding offer, but a non-binding invitation to place an order.
By placing an order, the customer makes a binding offer. The contract is only concluded upon our express acceptance (e.g. order confirmation or dispatch confirmation).
3. Prices and delivery charges
All prices include the applicable statutory value added tax. For PV products that meet the legal requirements for the zero rate of VAT in accordance with Section 12(3) of the German Value Added Tax Act (UStG), VAT is calculated at 0% and shown accordingly.
Any additional shipping charges will be clearly displayed to the customer during the checkout process.
4. Delivery and dispatch
Delivery will be made to the address provided by the customer.
The delivery time is specified in the relevant quotation.
The risk of accidental loss and accidental deterioration of the goods is not transferred to the customer until the goods are handed over.
Partial deliveries are permitted, provided they are reasonable for the customer.
5. Payment
Payment is made using the payment methods offered during the ordering process.
The purchase price is payable immediately, unless otherwise agreed.
6. Retention of title
The goods remain our property until full payment has been made.
7. Right of withdrawal
Consumers are entitled to a statutory right of withdrawal.
A separate cancellation policy and a model cancellation form are provided as part of the ordering process.
8. Warranty (Rights in respect of defects)
Statutory warranty rights apply.
9. Liability
We accept unlimited liability for damages resulting from injury to life, limb or health.
We shall only be liable for other damages in cases of wilful misconduct or gross negligence.
In cases of simple negligence, we shall only be liable for breaches of material contractual obligations (cardinal obligations) and such liability shall be limited to foreseeable damage typical for this type of contract.
Liability under the Product Liability Act remains unaffected.
10. Dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
11. Final provisions
The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods, provided that this does not conflict with any mandatory consumer protection regulations.
Please note: These Terms and Conditions apply exclusively to consumers. Separate terms and conditions apply to business customers.
Cancellation Policy
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party designated by you other than the carrier, took possession of the goods or has done so.
To exercise your right of withdrawal, you must notify us (Beltrona GmbH & Co. KG, Vor dem Weißen Stein 8, 72461 Albstadt-Tailfingen, Germany, telephone: 07573-95133-0, email: support@beltrona.de) by means of a clear statement (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, although this is not mandatory.
To comply with the withdrawal period, it is sufficient for you to send notification of the exercise of your right of withdrawal before the withdrawal period expires.
Consequences of withdrawal
If you withdraw from this contract, we shall refund to you all payments we have received from you including delivery costs (with the exception of any additional costs arising from your choice of a delivery method other than the one offered by us, the cheapest standard delivery), without undue delay and at the latest within fourteen days from the day on which notification of your withdrawal from this contract was received by us.
We will use the same payment method for this refund as you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees as a result of this refund.
We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
Returning goods
You must return the goods to us without delay and, in any event, no later than fourteen days from the day on which you notify us of the withdrawal from this contract, return them to us. To comply with the deadline, it is sufficient that you send the goods before the expiry of the deadline.
You are responsible for the direct costs of returning the goods.
Goods that cannot be dispatched by parcel post
Goods which, due to their nature, cannot normally be returned by parcel service will be collected from you by a haulage contractor commissioned by us. You shall bear the direct costs of returning the goods. These costs are estimated at a maximum of approximately €150 per consignment, and for ADR dangerous goods at a maximum of approximately €200 per consignment.
Collection will take place following prior arrangement of a date. Please contact us in advance so that we can arrange for the haulage company.
Reimbursement
You are only liable for any loss in value of the goods if this loss in value is attributable to handling of the goods that is not necessary for checking the nature, characteristics and functioning of the goods.
Exclusion or early termination
In particular, the right of withdrawal does not apply to contracts for the supply
- of goods which are not prefabricated and for the manufacture of which an individual selection or specification by the consumer is decisive, or which are clearly tailored to the consumer’s personal needs;
- sealed goods which, for reasons of health protection or hygiene, are not suitable for return if their seal has been removed after delivery.

Delivery and Payment Terms
Delivery
Delivery is available within Germany and to selected EU countries.
Delivery charges are displayed during the ordering process.
For goods shipped via a freight forwarder, delivery is “kerbside”.
We recommend that you check the goods for obvious transport damage upon delivery and, where possible, note this with the delivery driver; this makes it easier to assert claims against the transport company. The customer’s statutory warranty rights remain unaffected in all cases, regardless of whether an inspection was carried out upon delivery.
Delivery time
Unless otherwise stated, the delivery time is 2–5 working days.
Delivery times may vary for goods shipped via a freight forwarder.
Payment
The following payment methods are available:

- Klarna / Invoice (if offered)
The purchase price is payable immediately.
Default of acceptance
If the goods are not accepted without a valid reason, we reserve the right to charge you for any additional costs incurred as a result (e.g. for redelivery or storage). A validly exercised right of withdrawal remains unaffected by this.

We process personal data exclusively in accordance with the statutory provisions (GDPR).

Your data will be used for contract processing, delivery and payment processing.
