Battery Regulation (EU) 2023/1542

Dear Sir or Madam, 

We are working intensively on the implementation of the amended EU Battery Regulation and compliance with the new provisions of the Battery Act. In light of the changes to the EU Battery Regulation from 18 August 2024, we can assure you that we will comply with the new regulations. 

Aim and purpose of the new EU Battery Regulation (EU) 2023/1542 

The EU Battery Regulation is the key component of the European Green Deal and is intended to improve the circular economy, resource utilisation and efficiency as well as the service life of batteries in terms of climate neutrality and environmental protection. Companies that trade in, place on the market or even manufacture batteries in the EU as part of their business activities will be required to take greater responsibility in future in line with their market role. As market participants, they must ensure that batteries and all required raw materials are procured, processed and manufactured in accordance with internationally recognised social and environmental standards. 

Among other things, the Battery Ordinance regulates new recycling quotas, labelling requirements, maximum values for the CO2 footprint and minimum requirements for the shelf life and performance of batteries and rechargeable batteries placed on the market. The due diligence obligations associated with this and the new battery categories are subject to different deadlines. The Battery Ordinance defines the safety and labelling requirements for batteries based on an individual risk assessment. 

Compliance with the new requirements involves several steps, see note at the end of this letter. 

You will find more precise definitions in the expected implementing acts. We have adapted our incoming goods inspections in line with the requirements. This ensures that goods that have been/will be stored with us and were manufactured after 18 August 2024 comply with the new regulations and requirements of the Battery Ordinance.

Due to the equally valid protection of stocks of goods produced before 18 August 2024, these do not have to comply with the new regulations. These stocks can be declared at the request of the authorities. 

In this context, the legal requirements further oblige us to always sell non-compliant goods first during the transition period in which we still have them in stock. 

Of course, we can provide up-to-date declarations of conformity for all products that we place on the market. 

In addition, the CE mark on all products will in future supplement the declaration of conformity and represent the producer's declaration that all products comply with the requirements of the Battery Ordinance.
